New employment regulations in Abu Dhabi empower companies to hire remote workers and implement flexible working arrangements. The Abu Dhabi Global Market (ADGM) Registration Authority (RA) announced these regulations. These updates aim to clarify employer and employee rights and obligations.
Key Updates in the Abu Dhabi Regulations
One major change includes redefining ‘employee’ to accommodate remote and part-time work. These rules apply to firms regulated by the ADGM. Remote employees can reside within or outside the UAE. Their primary workplace must be located outside the employer’s premises at ADGM.
The new rules take effect on April 1. This allows employers time to align internal policies, employment contracts, and related processes with the updated requirements.
Key Provisions for Remote Workers
Under the new regulations:
Employment contracts must explicitly state the remote nature of the role.
Employers are responsible for providing and maintaining technical equipment necessary for remote work.
Companies must secure and cover the cost of work permits, residency visas, and ID cards for all employees, including remote staff.
Provisions for Part-Time Employees
Part-time contracts are defined as involving less than eight working hours per day. They also include fewer than five working days per week or terms differing from full-time practices. The regulations aim to address ambiguities around entitlements for part-time employees.
Workplace Practices and Protections in Abu Dhabi
The ADGM regulations incorporate provisions to prevent workplace discrimination and victimization. Employers must avoid discrimination based on gender, marital status, pregnancy, race, nationality, religion, age, or disability. Protections are also extended against retaliation for complaints or proceedings related to discrimination.
The probation period is capped at six months. During this time, employees are entitled to leaves and sick days but not sick pay. Termination during probation requires one week’s written notice.
